A United States judge has turned down the Department of Justice’s effort to compel Google to divest its advertising exchange platform, AdX, allowing the tech giant to maintain a significant segment of its ad technology operations. This decision comes despite previous rulings identifying that Google had unlawfully sustained monopolies in the sectors of publisher ad servers and ad exchanges.
Judge Leonie Brinkema, while upholding most of the proposed limitations on Google’s behavior, did not agree to mandate the sale of AdX. The Justice Department, supported by several states, had contended that Google’s historical actions warranted the relinquishment of control over AdX. In contrast, Google argued that a forced separation would pose technical challenges and potentially disrupt services for its clients.
This judgment marks a further obstacle for U.S. antitrust authorities who are striving to dismantle the dominance of major technology companies. Similar legal pursuits aimed at other prominent tech firms have previously failed to achieve mandatory divestitures of assets.
The ruling permits Google to retain its advertising exchange, while implementing conduct-related measures intended to mitigate concerns about competitive practices and the company’s interactions with publishers.
